Acceptance of Terms

By using the NextGen Design website, submitting an enquiry, requesting a quotation, engaging our services, or using any associated platform operated by NextGen Design, you agree to be bound by these Terms and Conditions.

Services

NextGen Design provides a range of digital, creative, and engineering-related services including website design, software development, mobile applications, AI-assisted design concepts, vehicle graphics, branding, signage design, automation consulting, and related services.

All services are provided subject to project scope, availability, technical feasibility, and client approval requirements.

Quotations and Estimates

Any quotation, estimate, proposal, or pricing indication provided by NextGen Design is valid for the period specified within the quotation unless otherwise stated.

Project pricing may change where additional requirements, scope changes, revisions, or unforeseen technical requirements arise after a quotation has been issued.

Client Responsibilities

Clients are responsible for providing accurate information, project requirements, logos, artwork, photographs, content, measurements, specifications, and approvals required for the completion of a project.

Delays caused by incomplete information, missing approvals, or late client responses may impact project timelines.

Proofs and Approvals

Design proofs, mockups, concepts, visualisations, and approval artwork are provided for client review prior to production or final delivery.

It is the client's responsibility to carefully review all proofs and verify:

• Spelling and grammar
• Contact information
• Measurements and dimensions
• Colours and branding
• Artwork placement and layout
• Technical specifications

Approval of a proof constitutes acceptance of the design as presented. Once approval has been given, the client accepts responsibility for the approved content.

Revisions

Reasonable revisions may be included within a project where specified in the project proposal. Additional revisions beyond the agreed scope may incur additional charges.

NextGen Design reserves the right to determine whether requested changes fall within the original scope of work.

AI-Assisted Design Services

Some concepts, mockups, and design explorations may be generated or assisted using artificial intelligence tools. AI-generated concepts are provided as creative visualisations and may require further refinement before production use.

Clients acknowledge that AI-generated imagery may occasionally contain inaccuracies, distortions, or inconsistencies that require human review.

Intellectual Property

All concepts, draft artwork, preliminary designs, working files, and development materials remain the property of NextGen Design until full payment has been received unless otherwise agreed in writing.

Upon full payment, the client receives the rights specified within the project agreement. Ownership of third-party assets remains subject to their respective licences and terms.

Website and Software Projects

Clients are responsible for maintaining appropriate backups of their own data, content, and systems. While reasonable care is taken, NextGen Design accepts no liability for data loss, service interruptions, hosting failures, third-party platform changes, or events beyond our control.

Limitation of Liability

To the maximum extent permitted by law, NextGen Design shall not be liable for indirect, incidental, consequential, special, or economic losses arising from the use of our services, website, software, designs, concepts, or recommendations.

Third-Party Services

Projects may incorporate third-party services, hosting providers, software platforms, application stores, AI systems, APIs, printing providers, signwriters, or external contractors. These third parties operate under their own terms and policies.

Termination

NextGen Design reserves the right to refuse service, suspend projects, or terminate engagements where abusive behaviour, unlawful activity, non-payment, or material breaches of these Terms occur.

Changes to These Terms

These Terms and Conditions may be updated periodically. Updated versions will be published on this website.
